South Carolina AI and Privacy Laws

South Carolina has no broad AI law or comprehensive consumer privacy law. 2025 laws make it a crime to create, possess, or share AI-generated child sexual abuse material and nonconsensual AI-generated intimate images.

What the law says

The Social Media Regulation Act, in effect since February 5, 2026, requires online services likely to be used by minors to protect minors’ data by default, bars targeted advertising to and profiling of known minors, and requires annual independent audits, with the first report due July 1, 2026.

The act faces a legal challenge from NetChoice.

What this means for your organization

This state regulates specific uses of AI rather than AI in general. Check whether any of your AI uses fall into the categories above, such as chatbots, synthetic media, or AI in health coverage decisions, and remember that federal law and the laws of other states where you operate may also apply.

Our 2027 AI Governance Checklist covers the steps most organizations need, and our State AI Law Trackers explain the rules for specific industries.
